Bayern’s Hernandez avoids jail charge for restraining order violation

The French defender has to pay a €96,000 fine, but he won’t have to serve jail time following his appeal being held up in court.

defender and his legal team filed an appeal against that charge as the prosecutor asked for a one-year jail sentence.

Hernandez attended court this month but his appeal wasn’t upheld. The 26-year-old, who played for Atletico Madrid in 2017, had an altercation with his girlfriend back then and was charged as she had to be hospitalized for minor injuries.

The court gave him a six-month restraining order but the two went on their honeymoon a couple of months later and left the country. When they came back to Madrid, the defender was arrested since he violated the court order. He was given a six-month jail time in 2019.

Hernandez’ appeal for the sentence was first rejected but his current was got accepted and he doesn’t have to serve any jail time.

Madrid's provincial court ruled on Wednesday that his prison sentence is suspended for four years, stating: 

"We are of the view that the appeal should be allowed and the detention order should be quashed.

"Regarding his family and social circumstances, it has been highlighted in the appeal that the convicted person lives with Mrs. de la Osa and their son, without any new incidents between them being recorded."

However, if he commits another offence in the next four years, his suspension will be revoked and he will be sentenced to jail time. He still has to pay a €96,000 fine
